SpoofProof
This End User License Agreement ("EULA") is a binding legal agreement between you ("Subscriber," "you," or "your") and SpoofProof USA, Inc., a Delaware corporation ("SpoofProof," "we," "us," or "our"). By creating an account, accessing our website, or using any SpoofProof service, you acknowledge that you have read, understood, and agree to be bound by this EULA, our Terms of Service, and our Privacy Policy.
SpoofProof grants you a limited, non-exclusive, non-transferable, revocable license to use the SpoofProof service and any associated ringer utility software solely for your personal, lawful use. This license is for a single phone number per subscription unless otherwise specified in your plan.
SpoofProof provides infrastructure-level call protection that intercepts and blocks robocall, spam, and spoofed-number calls before they reach your phone. SpoofProof is a network-based tool and solution that includes a mobile platform utility, installed on your device as a lightweight ringer utility. A utility is a specific type of app that enables another app or related system, in this case our network-based blocking and screening system, to function properly and effectively across mobile devices. We generally do not use the word "app" in our language, as that term is too general for what we provide. Detection and filtering happen within the telecom infrastructure, before a call is presented to your device. The ringer utility also serves as your phone's default dialer, enabling your phone to ring once a legitimate caller is passed through.
SpoofProof guarantees the blocking of automated robocall, spam, and spoofed-number calls that are delivered through automated dialing systems. This guarantee is backed by our money-back policy as described below.
No technology can prevent every unwanted call in every circumstance. Specifically, SpoofProof does not and cannot guarantee protection against:
We take your safety seriously even in situations we cannot directly prevent. Please visit our Scam Awareness & Safety Tips page for practical guidance on protecting yourself from all types of phone-based threats.
If robocall, spam, or spoofed-number calls that should have been blocked by our system reach your phone while your SpoofProof subscription is active and properly configured, you are entitled to a refund under the following terms:
SpoofProof is designed for standard personal use. We reserve the right to limit service, apply surcharges, or require an upgraded plan for any subscriber whose usage volume exceeds our per-subscriber cost ceiling. Volume thresholds are defined at SpoofProof's sole discretion and may change. Any such limitations or surcharges are based solely on usage volume and no other criteria. SpoofProof will notify the subscriber before applying any surcharge or requiring a plan upgrade.
You may not:
You must be at least eighteen (18) years of age to create a SpoofProof account. Individuals under eighteen may use the SpoofProof service, but a parent or legal guardian must be the account holder and is responsible for all account activity, billing, and compliance with this EULA.
By recording a greeting or BackFire clip through your SpoofProof account, you grant SpoofProof a limited license to store and play back that recording solely for the purpose of delivering the SpoofProof service. You represent that you are the person speaking in the recording or have authorization from the person speaking. SpoofProof will not use your voice recordings for any purpose other than service delivery.
SpoofProof subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. Annual subscribers will receive a reminder email thirty (30) days before renewal. Monthly subscribers will receive a reminder email five (5) business days before renewal. You may cancel at any time through your account dashboard.
We reserve the right to suspend or terminate your account at any time, at our sole discretion, for violation of this EULA, abuse of the service, or for any other reason we deem necessary to protect SpoofProof, our infrastructure, or other subscribers. You may terminate your account at any time by canceling your subscription and contacting us at spoofproofcontact@gmail.com.
EXCEPT FOR THE SPECIFIC MONEY-BACK GUARANTEE DESCRIBED IN SECTION 6, THE SPOOFPROOF SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOOFPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE. SPOOFPROOF'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SPOOFPROOF IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE ISSUANCE OF ANY REFUND DOES NOT CONSTITUTE AN ADMISSION OF NEGLIGENCE, LIABILITY, OR FAULT OF ANY KIND.
This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to this EULA or your use of SpoofProof shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You and SpoofProof each waive the right to a trial by jury.
YOU AND SPOOFPROOF AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
SpoofProof may update this EULA at any time. Material changes will be communicated via email or through your account dashboard at least thirty (30) days before they take effect. Your continued use of the service after the effective date of any changes constitutes acceptance of the revised EULA.
